As an essential element of its service Fadiga & Co will advise you on the options available to you for funding your case.

Private Clients
At your first meeting you will be told how we calculate our charges. Whenever possible we will give you a detailed breakdown of the estimated total costs, whether these are our own fees or for an external resource such as a barrister or expert. As with all solicitors, Fadiga & Co requires your authority to make these payments, known as disbursements, to other people on your behalf.

In litigation matters you may be able to recover your costs from the opposing party if you win your case.

Public Funding
At Fadiga & Co we undertake work funded by the Legal Services Commission (LSC). Public Funding (formerly known as Legal Aid) is a system of government funding, administered by the LSC, for those who cannot afford to pay for legal advice and representation. Franchises are granted by the LSC for practising in specific areas of law and are an endorsement of our quality system, client commitment and legal skills in those areas.

Public Funding is available for the majority of legal problems involving English Law. The following are excluded from Public Funding:

Most personal injury cases arising from negligence, other than clinical negligence

Cases arising out of carrying on a business

- Partnership disputes
- Company or Trust
- Boundary disputes
- Defamation cases

The two most commonly used forms of Public Funding are:

Legal Help: Under this scheme Fadiga & Co can provide general advice, write letters, negotiate, obtain a barrister’s opinion and advise if you have to go before a court or tribunal.

Legal Representation: This is required when you need to take or defend court proceedings and covers all work to trial and beyond. The Legal Services Commission (LSC) may impose limitations and conditions on the extent of funding. It is available in both family and civil cases. You may be eligible for Criminal Public Funding through which we can provide advice and representation at a police station and in the Magistrates Court, the Crown Court, and Appeals to Higher Courts.

In order to qualify for Public Funding you must satisfy a Legal Merits Test and a Financial Eligibility Test.
